Article 10 – Siting of Major Electric Generating Facilities

What is Article 10?

Article 10 provides for the siting review of new and repowered or modified major electric generating facilities in New York State by the Board on Electric Generation Siting and the Environment (Siting Board).  Article 10 provides a unified review and approval process for major electric generating facilities in New York State by addressing state and local permitting requirements in a single process.

Article 10 statute requires that an applicant must apply for and receive a Certificate of Environmental Compatibility and Public Need (Certificate) and meet the Article 10 requirements before constructing a generating facility.

Public Involvement

As part of the Article 10 process, applicants are required to actively seek public participation throughout the planning, pre-application, certification, compliance and implementation process.  Article 10 provides for individuals and stakeholders to participate in the review of an applicant’s proposal and offer input on the project that will be considered in determining the outcome of the proceeding.
