Case Update

The New York State Public Service Commission will hold four Informational Forums and four Public Statement Hearings regarding the Upstate NY Power Corporation's Article VII Application on Monday, November 16, 2009, and Tuesday, November 17, 2009.  In addition a pre-hearing conference will be held on Monday, November 16, 2009 immediately following the 11:00 a.m. Public Statement Hearing.

Background Information

On January 13, 2009, Upstate New York Power Corporation (UNYPC) filed an application to construct an electric transmission line under Article VII of the Public Service Law.    Article VII, "Siting of Major Utility Transmission Facilities," is the section of law that requires a full environmental, public health and safety impact review of the siting, design, construction, and operation of major transmission facilities in New York State.

The proposed 50.6 mile 230kV transmission line would extend from Galloo Island in the Town of Hoounsfield, Jefferson County, to the Fitzpatrick-Edic Substation in the Town of Mexico, Oswego County.  In its Article VII application, UNYPC specifically requests waiver of the following otherwise applicable provisions of 16 NYCRR:

  • NYSDOT Maps for Submarine Portion of Transmission Line {Section 86.3(a)(1) and 86.3(a)(2)};
  • NYSDOT Maps at 1:250,000 Scale {Section 86.3(a)(2)};
  • Nearby, Crossing or Connecting Rights-of-Way or Facilities of Other Utilities on NYSDOT Maps at 1:250,000 Scale {Section 86.3(a)(2)(iv)};
  • Aerial Photographs {Section 86.3(b)(2)};
  • Design Drawings {Section 86.6(b) and (c)};
  • Provide the System Reliability Impact Study (SRIS) as forwarded by the New York Independent System Operator's Transmission Planning Advisory Subcommittee (TPAS) for approval by the Operating Committee {Section 88.4(a)(4)}.

The public is invited to comment on the UNYPC's waiver request.  Comments may be submitted to the Commission until Monday, April 20, 2009 using the methods described below.  For more information regarding the UNYPC Transmission Line Proceeding, visit the UNYPC  Case 09-T-0049 page on the Department Website.  Information regarding how to apply for "party" status to the case can also be found at this location.
