Corning Gas Case 05-g-1359

Commission proceedings concerning Corning Natural Gas Corporation have been pending since Fall, 2005.   Highlights of the case are listed below:

Merger -  On July 19, 2006, the PSC approved the stock acquisition and merger of Corning Natural Gas Corporation (Corning) and C&T Enterprises, Inc (C&T), with certain conditions. Under the terms of the merger, Corning, under new C&T management, will freeze delivery rates for gas service at the current level through September 2009, refund to customers $1.4 million incurred in excess gas costs and nearly double capital investment in the gas system over the next five years. Commission Order - On May 22, 2006, the Commission issued an Order regarding service provided by Corning Natural Gas.  The Order sets gas new delivery service rates, adopts performance targets and incentives, allows deferral and rate recovery of certain costs, and credits customers with $1.4 million for excessive gas commodity costs incurred by the company last winter.

Joint Proposal -  On March 16, 2006, a number of parties in the case filed a joint proposal setting forth how they believe issues in the case should be resolved.  The joint proposal was supported by the Company, Department of Public Service Staff, Multiple Intervenors, the Bath Electric, Gas and Water Systems, and in part, by Fortuna Energy Inc.  On April 14, 2006, an Amendment to the Joint Proposal was filed. 

In May, 2006, the Joint Proposal was the subject of public statement hearings with the purpose of seeking public comment concerning the rates Corning Natural Gas Corporation should be allowed to charge prospectively to deliver natural gas and how such rates should reflect the Company's acts and practices leading up to the 2005-2006 winter heating season.  At its May session, the Commission approved the Joint Proposal and issued the Commisison Order on May 22.
